The ongoing creation of new designer chemicals used in the manufacture of herbal incense also known as “legal marijuana”, “synthetic pot” and similar products has created a billion dollar industry nationwide. Products such as K2, Spice, Mary Joy, Mr. Nice Guy, Black Mamba and others have received national attention due to an emergency temporary ban initiated by the DEA which went into effect on March 1, 2011 on jwh based products and others. Nonetheless, these products, and others, which are now manufactured, distributed and compliant with current laws, still remain on the fringe of “legal products” due to ever-changing legislation.

Attorney Marc Kurzman, who is now working of counsel with Siegel Siegel & Wright, individually represents retailers, distributors and manufacturers, in various states, at the extreme cutting-edge of herbal incense law and is at the very forefront of active litigation in both state and federal courts against the temporary ban (and State and local bans) of chemicals used to make herbal incense products . He is currently challenging the Constitutionality of “Synthetic ” laws, and he utilizes advanced techniques such as the Polygraph to reinforce the proof of his clients’ lack of knowledge that a particular substance in their possession and/or which they distributed/sold was “illegal” under whatever state, and federal law applies relative to any accusations.
Mr. Kurzman was formerly a pharmacist involved in synthesis of organic medicinal chemicals/drugs, and has initiated litigation in both state and federal courts in order to defeat the temporary ban by the DEA on March 1, 2011 which made the following chemicals illegal: JWH-018, JWH-073, CP-47,497, JWH-200, and cannabicyclohexanol.
